Updated Cybersecurity Regulations

Since November 2024, the Australian Government has updated corporate, privacy and cybersecurity regulations.

Companies can face substantial fines and penalties for failing to comply with regulations included in acts such as the Corporations Act, Privacy Act, and Cyber Security Act.

Corporations Act 2001
This act requires directors to act in the best interests of the company, which includes managing cyber risks effectively.
ASIC expects directors to ensure their organisation’s risk management framework adequately addresses cyber security risk and that controls are implemented to protect key assets and enhance cyber resilience. They warn that failure to do so could cause directors to fall foul of their regulatory obligations.

Privacy Act 1988 (updated November 2024)
This is the primary legislation governing the handling of personal information. It includes principles for the collection, use, and disclosure of personal information, as well as requirements for data security and access to personal information.

Cyber Security Act 2024
The Cyber Security Legislative Package 2024 introduces a mandatory ransomware and cyber extortion reporting obligation for certain businesses, sets minimum cyber security standards for smart devices, establishes a Limited Use mandate for the National Cyber Security Coordinator to promote industry-government engagement post-cyber incidents, and creates a Cyber Incident Review Board to review major incidents and share lessons learned.
